January Buffalo Village Board minutes
   The regular meeting of the Village of Buffalo was called to order at 7 p.m. Jan. 6 by Mayor Bill Vetter
with the Pledge of Allegiance to the flag.  Members present were:  Bill Vetter, Pam Paul, Bob Thaxton,
Lori Payne-Mullett, Tom Paige, Rose Magowan (acting treasurer), Phyllis Quick, village clerk, Bruce
Beeman, attorney.
   VISITORS:  Bob Brouse, from Perrino & Associates, Steve Gilbert, John Calise representatives
from Benton & Associates, Ken Kirby and Don Kirby.
   RECEPTION OF VISITORS:  Bob Brouse explained the audit of village records.  He suggested that
the village use Quicken or Quick Books for bookkeeping because it would be easier.  The village had
a very good audit.
   Steve Gilbreth said Benton & Associates was working with the Mechanicsburg-Buffalo Water
Commission to apply for an emergency grant to raise the wellheads that are in a flood plain.  He
needed three items:
   --A resolution of support that the Village of Buffalo will apply for the grant for the use of the
Mechanicsburg-Buffalo Water Commission.  Payne-Mullett made a motion to adopt said resolution,
seconded by Paige.  Roll call vote:  Magowan-yea, Paul-abstain, Thaxton-yea, Payne-Mullett-yea,
Paige-yea.  Motion passed.
   --An intergovernmental agreement with Village of Buffalo and Mechanicsburg-Buffalo Water
Commission that Village of Buffalo sign documents and checks submitted by the Water
Commission.  Thaxton made a motion to adopt said resolution, seconded by Paige.  Roll call vote:  
Magowan-yea, Paul-abstain, Thaxton-yea, Payne-Mullett-yea, Paige-yea.  Motion passed.
   --An agreement with Benton & Associates for grant administration.  Paige made a motion to adopt
said resolution, seconded by Payne-Mullett.  Roll call vote:  Magowan-yea, Paul-abstain, Thaxton-
yea, Payne-Mullett-yea, Paige-yea.  Motion passed.  Mr. Gilbreth said they also needed the Village of
Buffalo to support the infrastructure grant for public water system improvements.

   --A resolution of support with the VOB and Water Commission to apply for an emergency grant to
improve public water system.  Thaxton made a motion to adopt said resolution, seconded by Paige.  
Roll call vote:  Magowan-yea, Paul-abstain, Thaxton-yea, Payne-Mullett-yea, Paige-yea.  Motion
passed.
   --A resolution to enter into a governmental agreement with VOB and Water Commission.  Payne-
Mullett made a motion to adopt said resolution, seconded by Paige.  Roll call vote:  Magowan-yea,
Paul-abstain, Thaxton-yea, Payne-Mullett-yea, Paige-yea.  Motion passed.
   --An agreement with Benton & Associates for grant administration.  Thaxton made a motion to
adopt said resolution, seconded by Paige.  Roll call vote:  Magowan-yea, Paul-abstain, Thaxton-yea,
Payne-Mullett-yea, Paige-yea.  Motion passed.
   *Note:  Paul abstained as she is the billing clerk for Mechanicsburg-Buffalo Water Commission.
   Vetter than prefaced Kirby’s presentation by saying on behalf of the board, we are sorry things
have not worked out smoothly, but a septic tank was installed on the property before the board
approved such action.  The Sewer Commission approved a resolution to allow a septic system, but
permission from the Village is still required. Vetter also said the Kirbys need to understand this
property is in the Village, the County has limited jurisdiction and the Village of Buffalo has control.  
He has also noted cars parking too close to the street.  Attorney Beeman said the Village has an
ordinance as to the requirements of a driveway, and cars are to be parked on such driveway, not in
yards.  Beeman also stated that Tom Yonkers of the Sewer Commission is to inspect the septic
system before it is fully installed.  Ken Kirby said they had followed steps provided by the county, then
found out it was too costly to get the sewer line to the property.  Mr. Kirby is asking for a variance to
install and use a septic system for this property.  Vetter stated that if a Resolution is granted, there
will be no more variances granted for the remaining property, which is now zoned agriculture that it
must always remain agriculture.  Thaxton made a motion to adopt Resolution #09-VOB-1, A
RESOLUTION GRANTING AN EXEMPTION TO DONALD C. KIRBY WITH RESPECT TO THE
CONNECTION OF HIS PROPERTY TO THE BUFFALO, DAWSON, MECHANICSBURG SEWER
SYSTEM.  Motion seconded by Magowan.  Roll call vote:  Magowan-yea, Paul-yea, Thaxton-yea.  
Payne-Mullett-nay, Paige-yea.  Motion passed.  Payne-Mullett stated that poor planning does not
constitute a reason for changing the ordinance.  Kirby is to notify the Village of Buffalo when the
driveway is installed.
   READING OF MINUTES:  Paige made a motion to approve the minutes as mailed, seconded by
Payne-Mullett.  Motion passed.
   TREASURER’S REPORT:  Paige made a motion to accept the treasurer’s report, seconded by
Thaxton.  Motion passed.
   COMMUNICATIONS:  A petition has been filed for a Public Library District in the Tri-City area, to be
voted April 7.  There will be a caucus of the Citizens Party Jan. 12 at 7 p.m.  The pickup truck needs a
new radiator.  Cost to be $434.15.  Thaxton made a motion to install a new radiator in the Ford
pickup, seconded by Paul.  Roll call vote:  Magowan-yea, Paul-yea, Thaxton-yea, Payne-Mullett-yea,
Paige-yea.  Motion passed.  Application for Tree City USA has been submitted.
   READING OF THE BILLS:  Magowan read the bills for a total of $17,276.74.  Paige made a motion
to approve the bills, seconded by Payne-Mullett.  Roll call vote:  Magowan-yea, Paul-yea, Thaxton-yea,
Payne-Mullett-yea, Paige-yea.  Motion passed.
COMMITTEE REPORTS
   FINANCE COMMITTEE:  A rough draft of the 2010 budget has been started.
   PUBLIC HEALTH & SAFETY:  No report.
   STREETS & ALLEYS:  Need to meet with the engineer to inspect the streets for possible
resurfacing.
   PARK & BOULEVARD:  Most of the culverts have been cleaned.
   SIDEWALKS:  No report.
   POLICE:  No report.
   RECYCLING:  Paul reported that the grant money from the county has been received.  There will
be a TV collection in February.
   TREES:  Application for Tree City USA has been made.
   Suggested that a notice be put in the Post Office that any resident of the Village wanting to work for
the Village to contact Mayor Vetter.  
   Thaxton made a motion to adjourn, seconded by Paige.  Motion passed.  Meeting adjourned at 9:
30 p.m.
