Trustees turn down Carter request, Condon replaces

      Only four trustees, Burnley, Roderick, Skinner and Gleason were present for the Dec. 12 village board meeting.
      They heard from one guest, Prenice Carter Jr, who appeared before the board to request permission to add five more
vehicles for sale to the used car lot located on the corner of 6th Street and Route 104. He noted that tax time is busy and that they
would like to have as many cars on the lot as possible.
      Trustee David Skinner asked Carter if the current number of used vehicles permitted on the lot limits sales while Trustee
Mark Gleason said the request could be something the board could considered on a temporary basis. However, Mayor Clarke
noted the difficulty with snow removal and customer and employee parking concerns. Carter replied that the vehicles would be
rotated for snow removal, and we usually only have one customer at a time. Gleason asked if the board wanted to permit
additional vehicles, could it be done without having to change the ordinance.
      Mayor Clarke asked for attorney Myers counsel. Myers replied that village could choose not to enforce the ordinance however,
that would put you in the position of others requesting non-enforcement of village ordinances. The ordinance in question is a
permitted conditional use ordinance, with stipulations. If you change the number of vehicles currently allowed, the process must
start from scratch. Carters must set a meeting with the Zoning Board, pay the fee, make the request, hear any objections, etc.     
Following Myers counsel, Mayor Clarke told Carter Jr. that the board could not approve the request until Carter goes back to the
Zoning Board. Carter then asked if the two vehicles housed in the garage bays could be moved to the outside lot. Myers replied
that the two vehicles in the bays are part of the stipulation/s of the ordinance. If you want to pursue the request for additional
vehicles on the lot, the next step is to go to the Zoning Board.
      Trustees approved as presented the minutes of Nov. 28, bills payable of $102, 202, 89 as of Dec. 12, the monthly police
report, cancellation of the Dec. 26 village board meeting and the authorization for Treasurer Kelly Thein to pay all routine bills for
the last half of the month. In addition, trustees approved Ordinance 11-17, An Ordinance for the Levy and Assessment of Taxes
for the Village of Pawnee, IL for the Fiscal Year Beginning May 1, 2011 and Ending April 30, 2012.
      Mayor Clarke announced a change in the committee assignments. Trustee Steve Condon will replace Phillip Thompson on
the Bargaining Committee. Unfortunately, Thompson’s work requires him to travel a great deal and the reassignment will ensure
a full Bargaining Committee is available at any given time. Clarke also requested an executive session be put on the Jan. 9
village board meeting agenda in order to inform trustees of a collective bargaining session.
      The Pawnee Prairie Days Association requested a waiver or reduction of the $80 fee for the special event liquor license,
noting that Springfield charges non-profits only $25 for a special event license. Checking the village ordinance, it stated that the
fee for a special event license is $50 for the first day, and an addition $15 for each day thereafter. Trustees on a motion by
Trustee Mark Gleason, second by Trustee Skinner approved waiver of the fee for Pawnee Prairie Days. Trustee also approved
closing of the village square at 2 p.m. on June 6, 2012 in order for Prairie Days to begin setting up for the three-day event, which
will run June 7, 8, and 9.
